🇫🇷 Le président portugais António José Seguro a demandé au Tribunal Constitutionnel d’examiner, avant sa promulgation, le décret sur l’asile, la détention et le retour des étrangers — surnommé la « loi du retour ». Ce texte, porté par le gouvernement PSD/CDS-PP et adopté le 17 juillet avec le soutien de PSD, IL et CDS-PP (le Chega s’étant abstenu, la gauche ayant voté contre), allonge notamment à 180 jours — renouvelables une fois — la durée maximale de rétention des étrangers en centre d’accueil temporaire.
Seguro ne conteste pas le fond : « je suis contre l’immigration clandestine, il faut combattre férocement l’immigration illégale », a-t-il redit ce week-end. Mais il s’interroge sur la constitutionnalité de certaines dispositions, en particulier celles qui pourraient conduire à séparer des enfants de leurs parents ou à expulser des mineurs étrangers nés au Portugal âgés de moins de cinq ans. Le Chega, à l’inverse, juge la décision présidentielle « d’une extrême gravité », estimant qu’elle risque de forcer la libération de personnes en instance d’expulsion une fois le délai actuel de 60 jours écoulé.

🇬🇧 Portuguese President António José Seguro has asked the Constitutional Court to review, before it becomes law, the decree on asylum, detention and the return of foreign nationals — dubbed the « return law. » The bill, put forward by the PSD/CDS-PP government and passed on July 17 with support from PSD, IL and CDS-PP (Chega abstained, the left voted against), notably extends the maximum detention period in temporary holding centres to 180 days, renewable once.
Seguro isn’t disputing the substance: « I am against illegal immigration, illegal immigration must be fought fiercely, » he repeated this weekend. But he questions the constitutionality of certain provisions, particularly those that could lead to separating children from their parents or deporting foreign-born minors under five who were born in Portugal. Chega, on the other hand, calls the president’s move « extremely serious, » arguing it risks forcing the release of people awaiting deportation once the current 60-day limit runs out.
The topic is dominating conversations across the country right now — and touches, one way or another, on the broader question of how Portugal treats those who come to settle here, whether through legal channels or not.
